1. Agreement to Terms

By accessing or using Mosaiker ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Mosaiker ("we," "us," or "our").

We reserve the right to modify these Terms at any time. We will notify you of material changes via the email address associated with your account or by posting a notice on our website. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Service Description

Mosaiker provides content cloaking proxy software, including: the high-performance proxy, admin API, web dashboard, Docker deployment package, and associated updates and support ("Software"). The Software runs on your own infrastructure — we do not host or operate it on your behalf.

You are responsible for the deployment, configuration, and lawful use of the Software on your infrastructure. We provide the Software and support as described on our pricing page at the time of your subscription.

3. Acceptable Use

You agree to use the Software only for lawful purposes. You must not use Mosaiker to:

• • Violate applicable laws or regulations in your jurisdiction
• • Deceive search engines in ways that violate their published webmaster guidelines
• • Serve malicious, fraudulent, or harmful content to any visitor category
• • Infringe on the intellectual property rights of any third party

You are solely responsible for the content served through your deployment of the Software and for ensuring your use complies with all applicable laws and third-party platform policies.

4. Payment Terms

The Service is offered on a monthly subscription basis at the price listed on our pricing page. Payment is due in advance at the start of each billing period. We accept cryptocurrency payments including Bitcoin, Ethereum, Monero, and other supported digital currencies.

All cryptocurrency payments are final and non-reversible by their nature. Prices are denominated in USD; cryptocurrency amounts are calculated at the exchange rate at the time of payment. We are not responsible for exchange rate fluctuations.

If payment is not received within seven (7) days of the renewal date, your subscription may be suspended or terminated. You are responsible for maintaining valid payment arrangements.

5. Cancellation Policy

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. We do not provide pro-rata refunds for unused portions of a billing period, except as described in our Refund Policy.

Upon cancellation, your access to Software updates and support will cease at the end of the paid period. Docker images already pulled remain functional but receive no further updates.

6. User Obligations

You agree to:

• • Provide accurate information during account registration and keep it current
• • Use the Software only for lawful content cloaking and web optimization purposes
• • Maintain the security and confidentiality of your account credentials
• • Notify us immediately of any unauthorized use of your account
• • Not redistribute, resell, or sublicense the Software without written permission

7. Intellectual Property

All content, software, technology, and materials comprising the Service are owned by or licensed to Mosaiker and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Software for its intended purpose during your active subscription.

You may not copy, modify, distribute, sell, or lease any part of the Software, nor may you reverse engineer any component of the Software beyond what is permitted by applicable law.

8. Limitation of Liability

To the fullest extent permitted by law, Mosaiker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service.

Our total liability to you for all claims arising out of or relating to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

We do not warrant that: (a) the Software will be uninterrupted or error-free; (b) the Software will be compatible with all third-party systems or configurations; (c) visitor classification will achieve 100% accuracy in all environments.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration rather than in court, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations or emergency relief.
